Welcome to MAGELUR ("Platform", "Service", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of MAGELUR's website, mobile applications, and related services.

By accessing or using MAGELUR, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our Service.

2. Eligibility

You must be at least 18 years old to use MAGELUR. By using our Service, you represent and warrant that:

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

3.2 Account Types

MAGELUR offers different account types including Model, Photographer, Makeup Artist, Business, and Agency profiles. You must select the account type that accurately represents your role and professional status.

4. User Content and Intellectual Property

4.1 Your Content

You retain ownership of all content you post, upload, or share on MAGELUR ("User Content"). By posting User Content, you grant MAGELUR a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and promoting the Service.

4.2 Content Standards

You agree that all User Content you post will:

• Be accurate and not misleading
• Comply with all applicable laws and regulations
• Not infringe on any third-party rights
• Not contain harmful, offensive, or inappropriate material
• Not contain private information of others without consent

4.3 Model Releases and Rights

If you post photographs or videos featuring other individuals, you represent that you have obtained all necessary model releases, permissions, and rights to use and share such content on MAGELUR.

5. Prohibited Activities

You agree not to:

• Violate any laws, regulations, or third-party rights
• Impersonate any person or entity
• Post false, misleading, or fraudulent content
• Harass, abuse, or harm other users
• Spam or send unsolicited communications
• Attempt to gain unauthorized access to the Platform
• Use automated systems (bots, scrapers) without permission
• Interfere with or disrupt the Service
• Collect user data without consent
• Use the Service for illegal activities

6. Payments and Subscriptions

6.1 Subscription Plans

MAGELUR offers various subscription plans with different features and pricing. Subscription fees are billed in advance on a recurring basis (monthly or annually) and are non-refundable except as required by law.

6.2 Payment Processing

Payments are processed through third-party payment processors (Stripe). By providing payment information, you authorize us to charge the applicable fees to your payment method. You are responsible for maintaining valid payment information.

6.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. No refunds will be provided for partial subscription periods unless required by applicable law.

6.4 Booking Payments

For booking transactions between users, MAGELUR may facilitate payments but is not a party to such transactions. Users are responsible for fulfilling their contractual obligations to each other.

7. Verification Program

MAGELUR offers a verification program for users. Verification is granted at our sole discretion and may be revoked at any time. Verification does not constitute an endorsement or guarantee of a user's services, credentials, or reliability.

8. Disclaimers and Limitations of Liability

8.1 Service Provided "As Is"

MAGELUR IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 User Interactions

We are not responsible for the conduct of users or the content they post. You assume all risks associated with interactions with other users, including offline meetings or business transactions.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGELUR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

You agree to indemnify, defend, and hold harmless MAGELUR, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination:

• Your right to access the Service immediately ceases
• We may delete your account and content
• You remain liable for all obligations incurred
